JENNA ELIZABETH STUDIOS
Limited Edition Contract
This is a legally binding contract between Jenna Elizabeth Studios, LLC (hereafter “The Photographer” “Photographer” or “JES”) and the undersigned hereafter referred to as “The Client").
- The Scope of Work:
This contract is for services and products related to a photography shoot (hereafter “shoot” or “the shoot”) to take place at the above specified location on the above specified date.
PHOTOGRAPHER and CLIENT are to arrive for the SHOOT, 10 minutes prior to the above selected time.
PHOTOGRAPHER agrees to deliver digitally edited images to CLIENT. PHOTOGRAPHER is not required to provide more than the number of images stated in the package above.
Images are chosen by PHOTOGRAPHER.
- Fees:
In consideration for the photography services provided by the PHOTOGRAPHER, detailed in Section 1: The Scope of Work, the CLIENT agrees to pay the PHOTOGRAPHER in full upon signing this contract. CLIENT acknowledges this payment is non-refundable.
The payment reserves the PHOTOGRAPHERS time and is not a retainer or a deposit. PHOTOGRAPHER agrees not to not make this time slot available to any other potential clients. If the CLIENT cancels for any reason, this payment will not be returned to the CLIENT.
3. Rain Date:
*For outdoor sessions only:
If rain occurs and SHOOT needs to be rescheduled, PHOTOGRAPHER will offer 1 rain date (TBD). If CLIENT is not available on the rain date, a credit of equal value will be issued for future use.
4. Work Product:
PHOTOGRAPHER will deliver to CLIENT in an online gallery, digitally edited images with print release, within 3 – 4 weeks from SHOOT.
PHOTOGRAPHER will accept rush orders for an additional charge of $100.00. They will be DELIVERED to CLIENT within 3 days of shoot date.
Images delivered to CLIENT are licensed for reproduction for the CLIENT’S personal use only. They are not to be altered in anyway by CLIENT.
Though PHOTOGRAPHER may make recommendations for printing labs, CLIENT is responsible for any printing of digital images.
PHOTOGRAPHER is not responsible for nonprofessional printing labs. That includes but is not limited to: Staples, Walmart, Walgreen's, Shutterfly.
5. The Shoot:
Due to the short time frame for Limited Editon Sessions, CLIENT should arrive ready to shoot, 10 minutes prior to scheduled time slot. JES reserves the right to cancel any SHOOT in which the CLIENT is more than 10 mins late of scheduled time slot. CLIENT will not be refunded.
JES assumes no responsibility for any child(ren) who aren’t willing to participate or cooperate in their SHOOT. You will not be scheduled a re-shoot.
CLIENT is responsible for any JES Property damaged by CLIENT, and or CLIENTS child(ren).
JES reserves the right to cancel any session at any time.
JES must be made aware of ANY food allergies. JES assumes no liability or responsibility for any allergy that was not disclosed prior to SHOOT.
JES assumes no responsibility for parking availably. CLINET is responsible for metered parking when applicable.
6. Model Release:
By agreeing below, the PHOTOGRAPHER has the irrevocable right to use photographs in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, trade, promotion, exhibition, or any other lawful purposes. The Photographer can grant use of the images to third parties and all compensation for use and credit for the images remain the property of Jenna Elizabeth Studios, LLC.
CLIENT hereby waives any claims for ownership, income, editorial control and use of the images. (Please select your Model Release Preference Below).
7. Reproduction:
As stated above, if high resolution digital files are purchased, a written copyright release will be supplied with those files. The release grants the Client the right to reproduce the images provided for their personal use only and does not allow the photos to be sold or published. CLIENT further agrees not to supply images associated your SHOOT to any third party (including vendors) without the expressed written consent of JES.
8. Online Gallery:
Your online gallery will be available online for 60 days ONLY. After which time, your link will expire. Should you wish for your online gallery to remain open longer than the 60 day period, you will need to inform JES of your intentions no later than 40 days after SHOOT. Please note there is an incurred storage fee in the amount of $100 for 6 months or $150 for 1 year.
9. Signatures:
By the signing of this contract both parties, the PHOTOGRAPHER and CLIENT, have entered in the above agreed upon terms.
